Returns

According to the EU Distance Selling Directive, the consumer is protected by several safeguards and entitlements. Recharge Waterford is committed to complying with this directive. As a consumer you are entitled to a fourteen-day ‘cooling-off period*‘, whereby you are entitled to return your purchase to us for any reason** within fourteen days of receipt of same, and be refunded the price that you paid, minus the shipping charge. This safeguard applies only where the products in question are unopened, unused, undamaged, and returned to us in full saleable condition. Charges for return-shipment must be borne by the purchaser.

* The cooling-off period only applies to B2C clients. B2B clients have no such entitlement according to the Distance Selling Directive.

**‘Specials’, once accepted by you as such, can not be returned to us.

Items that fall outside the 14 day cooling-off period will be considered on a case-by-case basis. Recharge Waterford reserves the right to decline to accept returns and/or to levy a re-stocking fee.

Guarantee

The guarantees on our various product lines are as follows:

Original products:

In the event that you’ve purchased a faulty original or OEM product from Recharge Waterford please contact the manufacturer directly for further instruction. Many original equipment manufacturers require that the end-user initiate such returns procedures directly with them (but we will of course honour the guarantee if the OEM suggests that course of action). The warranty period is limited to 12 months from date of invoice. Please feel free to contact us with any queries you might have.

Compatible products

In the event that your compatible purchase is faulty Recharge Waterford will offer a 12 month warranty.

Re-manufactured products

In the event that your re-manufactured purchase is faulty Recharge Waterford undertakes to replace said product or refund the product purchase price, for a period of 12 months from the date of purchase.

In each of the cases above please contact us directly for a Return Merchandise Authorisation (“RMA”) number BEFORE returning goods. This RMA number and a copy of the delivery note or invoice must accompany any item being returned to us. Shipping charges are non-refundable. The following conditions must be satisfied for a valid guarantee claim:

The claim must be made and a RMA number requested within the guarantee period.
This may be done by email, fax or telephone, the product must be returned to us within 5 working days of receipt of the RMA number, the article must be packaged properly, the guarantee form must be clearly filled out with your address, telephone number and RMA number. A copy of the delivery note or invoice must accompany the returned item(s). The customer assumes responsibility for any anomalies that may arise during shipment (i.e. damaged or destroyed goods, delays etc.).

Refunds

Refunds will be issued in the same form as the original payment. If paid for by credit card, a credit will be issued to the original credit card number provided on that specific order. If product(s) purchased from Recharge Waterford should be returned for whatever reason, the customer shall return the product(s) to us under the following terms:

RMA number

Customer must obtain a Return Merchandise Authorisation (“RMA”) number by contacting customer service. An RMA must be requested within 7 days of receipt of goods.

Supporting documentation

Customer shall return the products to Recharge Waterford, along with the original invoice or delivery note (or a copy of either). A sample of print defect in cases of print quality issues. If no invoice is to hand, please include a letter specifying the problem, and including date of purchase, invoice number and customer ID (if known). Also please include your first and last name, and your phone number. This will help us expedite a solution and allow us to contact you if there are any problems or concerns regarding your return.

Return to Recharge Waterford

Before a refund and/or reshipment can be issued, the cartridges in question must be returned to Recharge Waterford. Recharge Waterford will not be responsible for damaged parts if customer does not follow this process. Please retain shipping information including tracking numbers, until your account has been credited by Recharge Waterford or replacement product is received. Recharge Waterford cannot be held liable for any lost packages that are not given any type of tracking number or documentation. If Recharge Waterford determines that failure of the product(s) was not as a result of a defect in materials or workmanship, or if the reason for return does not involve failure, then Recharge Waterford reserves the right to charge the customer for parts and labour at Recharge Waterford current labour rate, or charge the customer a 20% restocking fee. Recharge Waterford will advise customer prior to assessing these charges.

If no order number, invoice number, delivery note or RMA number is included, there will be a delay in the returns process. If you do not state whether you desire a refund or a replacement, a standard replacement will be issued. You will not receive a refund or reshipment if you use over 25% of the product.

Taxes

All products offered for sale on this site display prices both exclusive of and inclusive of VAT at the prevailing rate in Ireland.

Payment

Unless paid for via our secure online payment system, or otherwise stated, all payments shall be due upon receipt of an invoice. Recharge Waterford reserves the right to obtain a security interest in all products sold to the customer, and in proceeds thereof, until the customer makes full payment. A €30 collection fee will be charged for any and all dishonoured cheques.

We trust Stripe to process our card transactions, and we haven’t been let down to date.

 

Prices

Recharge Waterford reserves the rights to change the prices of any or all of its products without prior notification. Please note that both ex-VAT and VAT-inclusive prices are prominently displayed beside each product’s order button.

Delivery

Recharge Waterford is based in Waterford, where we have a retail premiss. We hold stock of most of the fast movers. Some items will be fulfilled through our stock fulfilment partner in Dublin. We use An Post and GLS for next day delivery throughout Ireland.

 

Risk of Loss

Recharge Waterford liability for delivery shall cease, and title and all risk of loss or damage to the products as a result of misuse, or damage to personal property as a result of misuse shall pass on to the customer.

 

Undelivered Products

A 15 business day waiting period is required before any product shall be resent or any order be cancelled at the discretion of Recharge Waterford, per customer request.

 

Terms of Limited Warranty

Recharge Waterford warrants to the original customer purchasing such products directly from Recharge Waterford that all such products sold will be free from defects in materials and workmanship affecting form, fit and function. Any claim alleging that any product fails to conform to the foregoing warranty may be made only by the customer who purchased such product and only while such customer owns such product. Recharge Waterford, at its option, will repair, replace, or provide a credit or refund of either the original purchase price or fair market value, whichever is lower, for a product that is determined by Recharge Waterford to be defective. Recharge Waterford reserves the right to substitute functionally equivalent new or serviceable used parts. The Limited Warranty covers only defects arising under normal use and does not include malfunctions or failures resulting from misuse, abuse, neglect, alteration, problems with electrical power, usage not in accordance with product instructions, acts of nature or improper installation or repairs made by anyone other than Recharge Waterford.

Recharge Waterford MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OTHER THAN THAT Recharge Waterford WARRANTS THAT SUCH PRODUCTS ARE SUITABLE FOR USE IN THE PARTICULAR MACHINE FOR WHICH THEY ARE DESIGNED. Any claim with respect to such products must be made 30 days from the original date of shipment from the Recharge Waterford premises and Recharge Waterford shall have no liability thereafter. All WARRANTIES cover only defects arising under normal use and do not include malfunctions or failure resulting from misuse, abuse, neglect, alteration, problems with electrical power, usage not in accordance with product instructions, acts of nature or improper installation or repairs made by anyone other than Recharge Waterford or a Recharge Waterford authorised third-party service provider. Recharge Waterford, at its discretion, will repair, replace, or provide a credit or refund of either the original purchase price or fair market value, whichever is lower, for any product covered by the foregoing warranty that is determined by Recharge Waterford to be defective. Recharge Waterford reserves the right to substitute functionally equivalent new or serviceable used parts.

 

Limitations

RECHARGE WATERFORD MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND RECHARGE WATERFORD DISCLAIMS AND NEGATES ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONFORMITY TO MODELS OR SAMPLES, OR ANY WARRANTIES OR INDEMNITIES AGAINST INTELLECTUAL PROPERTY INFRINGEMENT. IN NO EVENT SHALL RECHARGE WATERFORD BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. ALL DISPUTES ARISING OUT OF OR RELATED TO THE LIMITED WARRANTIES SET FORTH HEREIN (CUSTOMER DISPUTES) SHALL BE GOVERNED BY THE LAWS OF THE REPUBLIC OF IRELAND. CLAIMS AGAINST RECHARGE WATERFORD FOR SHORTAGES SHALL BE DEEMED WAIVED IF NOT MADE WITHIN THREE (3) BUSINESS DAYS AFTER RECEIPT OF THE SHIPMENT.

 

 

Assignment

Customer may not assign its rights or obligations hereunder without the express prior written consent of Recharge Waterford.

 

Entire agreement

These terms and conditions, including those on the face hereof, constitute the entire agreement with regard to this sale and expressly supersede and replace any prior or contemporaneous agreements, whether written or oral, relating to said sale, including any terms and conditions on any of customers documents or purchase orders. This agreement shall be binding upon the heirs, successors and assigns of the parties hereto. If any provision of this agreement shall be held to be invalid or unenforceable, the remainder of this agreement shall remain in full force and effect.

 

Governing law, jurisdiction and costs

This agreement is governed by the laws of the REPUBLIC OF IRELAND, without regard to its conflict or choice of law provisions. Customer acknowledges and agrees that the REPUBLIC OF IRELAND is an appropriate place for venue of any litigation and that REPUBLIC OF IRELAND courts have jurisdiction over this agreement and customer. In the event the customer and Recharge Waterford are unable to resolve any customer dispute, and any collection action, suit or other judicial proceeding is commenced, the prevailing party in any such collection action, suit or judicial proceeding shall be entitled to recover its costs and reasonable legal fees incurred.

 

Terms and Conditions

This sale is subject to the terms and conditions stated herein, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by customer, including, without limitation, purchase orders and specifications. In case of conflict between the terms and conditions stated here and those on the face hereof, those on the face hereof shall control. ANY ADDITIONAL, DIFFERENT OR CONFLICTING TERMS AND CONDITIONS ON ANY SUCH DOCUMENT ISSUED BY CUSTOMER AT ANY TIME ARE HEREBY OBJECTED TO BY Recharge Waterford, AND ANY SUCH DOCUMENT SHALL BE WHOLLY INAPPLICABLE TO ANY SALE MADE HEREUNDER AND SHALL NOT BE BINDING IN ANY WAY ON Recharge Waterford.
